These Terms and Conditions (the "Terms") are a legally binding agreement between Aspect Health Global Inc. (also referred to as "Aspect Health", "we", or "the Owner") and any person or entity ("you" or "the User") using the Aspect Health application, website (aspect-health.com), or any related services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms, so please read them carefully.

Although your contract for using the Service is solely between you and the Owner, if you accessed the Aspect Health app via the Apple App Store, you acknowledge that Apple, as a third-party beneficiary, may enforce these Terms against you.
The Service is provided by Aspect Health Global Inc., located at 919 North Market Street, Suite 950, Wilmington, DE 19801, USA.
Aspect Health encourages you to consult with your healthcare provider before using our Service. By using the Service, you represent that you are in sufficiently good health to begin using it, which may include making changes to your diet or level of physical activity. If you have an existing health condition that could be affected by using the Service, you confirm that you have obtained approval from a qualified healthcare professional to use the Service. Using Aspect Health requires your active participation and effort. You understand that individual results will vary for a variety of reasons, and we cannot guarantee that you will achieve your health goals or any specific outcomes.
THE SERVICE DOES NOT INCLUDE THE PROVISION OF MEDICAL CARE BY ASPECT HEALTH GLOBAL INC. OR ANY THIRD PARTY. ASPECT HEALTH GLOBAL INC. IS NOT A LICENSED MEDICAL CARE PROVIDER, AND OUR COACHES ARE NOT ACTING IN A HEALTH CARE PROFESSIONAL CAPACITY. OUR COACHES DO NOT PROVIDE ANY MEDICAL OR CLINICAL SERVICES, AND DO NOT DIAGNOSE, TREAT, OR MANAGE ANY ILLNESS, DISEASE, OR CONDITION. ASPECT HEALTH GLOBAL INC. AND OUR COACHES DO NOT HAVE EXPERTISE IN DIAGNOSING, EXAMINING, OR TREATING MEDICAL OR PSYCHOLOGICAL CONDITIONS OF ANY KIND, OR IN DETERMINING THE EFFECT OF ANY SPECIFIC EXERCISE OR DIET ON A MEDICAL CONDITION.
YOU SHOULD NOT CHANGE YOUR TREATMENT OR CARE PLAN, MEDICATION, OR THERAPY BASED ON INFORMATION you receive through the Service or from one of our coaches. Consultation with our coaches is supplemental to any treatment or care provided by your healthcare provider and should not replace regular medical visits with your provider. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN or other qualified health practitioner regarding your medical condition or before using any medication or medical device. Information provided by our coaches is for informational purposes only and is not a recommendation or endorsement of any drug, device, or treatment, nor a representation that any particular drug, device, or treatment is safe, appropriate, or effective for you.
QUESTIONS REGARDING ANY DRUG, DEVICE, OR TREATMENT SHOULD BE DIRECTED TO YOUR HEALTHCARE PROVIDER. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT because of something you have read in connection with the Service. ALWAYS CONSULT with your healthcare professional if you have any questions or concerns about your health or if you experience any changes in your condition or health status. The Service does not include emergency or urgent care services. If you think you have a medical emergency, call 911 or go to the nearest emergency room immediately.
We reserve the right, in our sole discretion, to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to the Service (or any part of it) immediately and without notice for any reason, including (but not limited to) your violation of these Terms. You agree that we shall not be liable to you or any third party for any termination of your access to the Service, and you agree not to attempt to use the Service after your account has been terminated or suspended.
We do not sell user data to third parties. You have the option to export your own data from the Service and share it with third parties if you choose to do so. Aspect Health may share aggregated and/or anonymized user data (which cannot reasonably be used to identify you) with third parties for research purposes if such research could help us improve our services or the functionality of the app. We also reserve the right to use aggregated, statistically processed, and/or anonymized user data (non-identifiable information) to publish research that contributes to open science and general wellness knowledge.
Aspect Health is not a medical app and is not intended for medical purposes of any kind. Any analysis of your heartbeat, workout, sleep, nutrition, or other lifestyle data provided by our Service is intended for recreational and wellness purposes only – to help you make healthier lifestyle choices. You should not assume this data is scientifically or medically accurate, and it cannot be used for any medical purpose, including diagnosing, treating, curing, or preventing any disease or condition.
